The Importance of Software Licensing

With software becoming more widespread in our daily lives, we ought to become acquainted with important concepts like licensing. Despite software licensing posing as a rather tricky idea, customers must endeavor to learn its intricacies of it to improve computer program creation.

What is Software Licensing?

A software license is a legal tool that allows users to use or redistribute the software. Without a license agreement, using the computer program could constitute a breach of copyright law. The specific license agreement will describe how the users may use the computer program. All software must be licensed before it can be installed. Where software licensing becomes perplexing is in the rights connected to the licenses and types of licenses.

Strategies for Licensing Software

An end-user license agreement (EULA) is an approach vendor can choose to license their software. This is a contract between the buyer and the licensor, establishing the rights of the purchaser. The contract may include ways the software may be used, in addition to buying the software, and any rights the buyer has. This is one of the most frequently used and basic methods to license software.

When you are using SaaS and your applications are cloud-based, the software license is usually subscription-based. In other words, you pay for every user on a monthly (or another interval) basis. This type of software license offers flexibility. It’s also valuable because you only pay for what you need, allowing you to scale your company without consequences.

There is also the question of whether you can re-install your software license if you are no longer using it. There is no answer to this issue. The solution can be found in the EULA. From a legal perspective, there could be question marks on the enforceability of EULAs granted to customers when they bought the software, given they were not aware of those terms at the time. I won’t go into depth.

Another method of licensing software is by white-labeling it. This is where a product is made by one company and sold to another corporation. As a result, the software/product belongs to the purchasing company. A software license is put in place that allows the organization profiting to use the software.

Why Software Licensing Is Crucial

Companies need to be knowledgeable about the licenses they purchase to ensure firstly that they are using software legally and secondly, that they are not paying for licenses that are not used. By obtaining too many software licenses, you are wasting business resources; without enough, you leave yourself liable to potential litigation (which is rather pricey). Finding the proper license agreement can make it easier to manage the software.
